Abstract

ln particular, by studying several cases of contract maniage (married mut’ah) and phenomena that exist in lndonesian society, especially among Muslims, then there lndonesian women's rights, as follows: the right to survival / life assurance, the right to protection and security and happiness, custody of children bom from the marriage contract. This research aims to find out the marriage contract of lndonesian women with foreign men in terms of juridical and social economic terms. The method used is descriptive and qualitative. Custody of children born in a contract marriage (married mut’ah) this becomes major and important, because concerning the rights of the mother who mention edabove. Although born into a marriage contract, the rights of a child are protected and this is in accordance with the Declaration of the Rights of the child principle 2, 3, 4, 6 and 7
