Abstract

Indonesia, while tackling terrorism crimes, relies on a soft and hard approach. The soft approach is carried out by BNPT RI together with related ministries/institutions and involves the community. Polri took a tough approach in the context of law enforcement, together with the military-TNI. The development of the methods operandi of terrorism crimes demands that in the future Indonesia formulate a new approach model based on crimes of terrorism against national security. The "smart approach" model in form soft-medium-hard can be a reference for the limits of the scale of the threats and what forms of counter measures and how to tackle terrorism crimes. This paper aims to see what Indonesia's criminal policies have been in countering terrorism and analyze Indonesia's criminal policy in tackling terrorism in the future. This article concludes that, first, Indonesia has been using the criminal policy to tackle terrorism crimes using two approaches, namely: soft and hard. Second, for the future, to tackling terrorism crimes with criminal policy ideally uses a smart approach which consists of the three models: soft-medium-hard. The soft approach was taken by BNPT RI, the medium approach by the Polri-TNI, and the hard approach by tne TNI-Polri.
